ما هو الأسلوب القانوني الجنائي الأمثل لحماية حق الملاحة البحرية من ظاهرة الإرهاب البحري من الناحيتين الموضوعية والإجرائية، وعلى المستويين الدولي والوطني؟ وسبل التعاون الدولي الجنائي لمواجهة خطر الإرهاب البحري وتدابير منع وقوع الجريمة؟ ذلك هو السؤال الذي نخصص هذا البحث للإجابة عليه وذلك لعدة أسباب، ودراستنا لموضوع البحث هي دراسة تأصيلية تحليلية تطبيقية تقديرية مقارنة في إطار المنهج المتكامل الذي يستند على حقيقة وجود ارتباط وتلازم بين الإطار العلمي للبحث، وبين الواقع العملي.
وكذلك منهجنا في دراسة اتفاقيتي حماية الملاحة البحرية من الإرهاب البحري (روما لعام 1988، لندن لعام 2005) والبروتوكولات المكملة لها يتقيد بالترتيب الزمني الذي صيغت فيه أحكامها، وتوزيع تلك الأحكام على أساس علمي يعتمد على وحدة الموضوع، وأخيرًا هي دراسة تطبيقية بما عليه الوضع الراهن في التشريعات الجنائية المقارنة "الأجنبية والعربية والإسلامية" بشأن حماية حق الملاحة البحرية من الإرهاب البحري.
أما خطة البحث تتكون من فصل تمهيدي عن أولويات حول موضو الدراسة، من ثلاثة مباحث هما المبحث الأول: تعريف الإرهاب البحري، المبحث الثاني: تاريخ الإرهاب البحري، المبحث الثالث: تحديد نطاق الحماية، ثم الباب الأول: الحماية الجنائية الموضوعية للملاحة البحرية من الإرهاب البحري، والباب الثاني: الحماية الجنائية الإجرائية للملاحة البحرية من الإرهاب البحري والتعاون وتدابير المنع.
