قد استقر الفقه والقضاء على أن العيوب الشكلية، والموضوعية، تؤدي إلى بطلان القرار الإداري لمخالفته لمبدأ المشروعية، وتتمثل العيوب الشكلية في عدم الإختصاص، أما عن العيوب الموضوعية وتتمثل في مخالفة القانون واللوائح، والإنحراف بالسلطة أو إساءة استعمالها، وتتحقق الأولى عندما يكون القرار مخالفاً للقانون بالمعنى الواسع ويتحقق الآخر عندما تنحرف الإدارة عن المصلحة العامة والهدف الذي خصصه المشرع لإصدار القرار، وسوف نقسم هذه الدراسة إلى فصلين: (الفصل الأول: رقابة عدم المشروعية الشكلية للقرارات الإدارية، الفصل الثاني: رقابة عدم المشروعية الموضوعية للقرارات الإدارية) وسوف نقوم بتقسيم هذين الفصلين إلى مجموعة من المباحث والمطالب والفروع حسب مقتضيات البحث العلمي كما أننا سوف نبين في ثنايا هذه الدراسة موقف الشريعة الإسلامية من العيوب الشكلية والموضوعية للقرارات الإدارية المخالفة لمبدأ المشروعية.
