رغبة في حماية حقوق الأفراد وحرياتهم، كان لابد أن يترتب جزاء على مخالفة سلطات الإدارة للقانون. ولقد جرى فقه القانون الإداري وقضاؤه على أن هذا الجزاء قد يتخذ صورة إبطال العمل الإداري المخالف للقانون وتعويض الأفراد عما أصابهم من أضرار بسببه. وقد يقتصر الجزاء على تعويض الأفراد فقط عن الأضرارالتى لحقت بهم من تنفيذ القرار الإداري غير المشروع. ولقد رأينا أن يقتصر موضوع بحثنا بصورة أساسية ، على جزاء واحد من الجزاءات التى يمكن ان تترتب على مخالفة التصرف للقانون وهو الجزاء الذي يتخذ صورة بطلان العمل الإداري. ويعد القرار الإداري أبرز مظهر يتجسد فيه سلطان الإدارة، إذ تستطيع جهة الإدارة عن طريقه، بارادتها المنفردة ، أن تصدر أمرا ملزما للأفراد تحد به من حرياتهم وتحدد به حقوقهم وعلى ذلك فضلنا أن يقتصر بحثنا على هذا النوع وحده دون غيره من الأعمال الإدارية الأخرى.
