انطلاقًا من الأهمية الحاسمة للاستثمار في إطار تحقيق التنمية الاقتصادية في العراق عمومًا وإقليم كوردستان العراق خصوصًا، فقد اختار الباحث موضوع بحثه هذا بهدف التعرف على فاعلية الدور الذي لعبه الاستثمار بشكل عام والاستثمار الصناعي بشكل خاص من خلال استعراض القوانين الخاصة بالاستثمار منذ بداية نشوء الدولة العراقية في عام 1921 وحتى العهد الجديد بصدور الأمر (39) في 2003 عن سلطة الائتلاف المؤقتة في العراق، هذا من جهة، ومن جهة أخرى، فإنه ليس بخافٍ على أحد ما تمثلها السياحة من أهمية اقتصادية متزايدة.
وقد تنوعت صناعة السياحة بحيث لم تعد حكرًا على زيارة المتاحف والأماكن الأثرية بل أصبحت شاملة لنشاطات أخرى دينية وعلاجية ورياضية وثقافية وفنية فضلًا عن سياحة المؤتمرات والمهرجانات. مما يتطلب تنظيم الاستثمار بشكل عام والاستثمار السياحي بشكل خاص.
ووفقًا لهذا اشتمل هذا البحث على خمسة فصول: تناول الفصل الأول مفهوم الاستثمار ومجالاته ومعوقاته والحماية القانونية للاستثمار ومشجعات وفرص الاستثمار في العراق، وتناول الفصل الثاني قوانين الاستثمار ومناطق التجارة الحرة في العراق، أما الفصل الثالث فقد تعرض لمستجدات الاستثمار في القانون العراقي واتفاق إجراءات الاستثمار في الـ(WTO)، وعلى الأخص ما جاء به القانون العراقي الجديد (الأمر رقم 39) لسنة 2003، وتعرض الفصل الرابع للتنظيم القانوني للسياحة والاستثمار السياحي، وأما الفصل الخامس والأخير فقد تناولنا فيه أهم التطورات القانونية في مجال الاستثمار بشكل عام والاستثمار السياحي بشكل خاص في إقليم كوردستان العراق، وأنهينا الدراسة بخاتمة تضمنت أهم الاستنتاجات والتوصيات.
