تأتي أهمية هذا الكتاب من حالة الظلم التي كانت ولا تزال تعاني منها الدول النامية حيث كان العدد الكبير منها تحت الإستعمار من قبل الدول الكبرى... فلم يكن لها صوتاً يسمع ولا رأياً يؤخذ به وحتى الإتفاقيات الدولية التي كانت تعقد فقد كانت تعبر عن وجهة نظر الدول البحرية الكبرى كما هو واضح في إتفاقيات جنيف الأربع عام 1958 وحتى في المؤتمر الأول والثاني لعام 1958 وعام 1960 كانت الدول النامية غائبة لأنها كانت تخضع للإستعمار فترة طويلة من الزمن مما أدى إلى إستغلال مواردها الإقتصادية ابشع إستغلال، فحاولت هذه الدول الصغيرة بعد إستقلالها أن توحد جهودها لمصارعة الإستعمار والوقوف بوجه الدول الإستعمارية وبذل جهود كبيرة لتغيير قواعد القانون الدولي التقليدي للبحار بما ينسجم ومصالح هذه الدول كما خشيت هذه الدول أن تستغل الدول الكبرى الثروات التي تخزنها قيعان البحار والمحيطات في ظل مبدأ الحرية التقليدية لأعالي البحار والمحيطات ومن الأسباب التي جعلتنا نعطي إهتماماً لهذا البحث هو التقدم العلمي والتكنولوجي الذي بدأت آثاره في مجال الإستغلال الإقتصادي لأعماق البحار والبحار العالية وإستخراج الثروات الحية وفي غياب التنظيم الدولي لهذا الإستغلال يصبح المجال فسيحاً أمام الدول الصناعية الكبرى للإستغلال دون مراعاة لمصالح المجتمع الدولي، كما أن الزيادة الكبيرة في أعداد السكان في العالم وعدم كفاية الموارد المتاحة أخذت تتجه الأنظار إلى ذلك الخزين العظيم من الثروات الحية والمعادن حيث لا يمكن حل هذه المشكلة إلا عن طريق التعاون الدولي وفقاً لقواعد قانونية يحكمها القانون الدولي للبحار.
