يبحث هذا الكتاب في القانون الواجب التطبيق على عقود الإستثمار الأجنبي بإحدى وسيلتين، الأولى، تلك التي يتم فيها هذا التعيين من خلال نظرية التنازع التقليدية ... أما الوسيلة الثانية فهي تشمل إحدى حالتين: الأولى القواعد المادية المباشرة، من خلال البحث عن مصادرها، وكيفية إعمالها، والثانية حالة التطبيق الحتمي المباشر لقانون معين مسبقاً – وهو ما يسميه الفقه الحديث بالتطبيق المباشر أو الضروري للقوانين الوطنية – من هنا تبدأ المؤلفة بالبحث عن المعيار الذي يتم بموجبه تحديد هذه القواعد، وتتساءل عن دور القضاء في إعمال القوانين الأجنبية ذات التطبيق الضروري؛ وهل من مجال لإعمالها على حساب القانون الذي تشير إليه قواعد الإسناد الوطنية؟ وهل على المحكم الدولي واجب تطبيقها، وهو الذي يعتبر محرراً من قانون وطني خاص به، وما هو أثر الطابع الإتفاقي للتحكيم على إعمال هذه القواعد؟
