إن التشريعات الوضعية، كما هو معلوم، من وضع البشر وأن المشرع عند صياغته للقاعدة القانونية يتوخى أن تعالج الإشكاليات القانونية القائمة والمتوقعة لذلك يصوغها بصياغة عامة مجردة إلا أنه في جميع الأحوال لا يستطيع الإلمام بجميع الفروض الآنية والمستقبلية مما يجعل ما يسنه من تشريعات يشوبها النقص والغموض ومن ثم فهي بحاجة إلى دراسة وتفسير وتحليل ناهيك عن قصورها عن معالجة جوانب معينة من الحالة القانونية التي جاءت لمعالجتها.
وتوضع القاعدة القانونية لتنظيم العلاقات الإجتماعية بين الأفراد في المجتمع مما جعل القوانين نسبية من حيث الزمان والمكان وما يصلح لزمان آخر وما يصلح لبلد لا يصلح لآخر، ومن هنا نجد المشرعين يتابعون القوانين بالتعديل وأحياناً بالإلغاء وسن تشريعات أخرى تحل محلها لأنها لم تعد تتلاءم مع متطلبات العصر، أو لا تفي بمعالجة الإشكاليات القانونية التي جاءت لمعالجتها.
وحيث أن الفقه يضطلع بتفسير القواعد القانونية ويبين ما شابها من غموض أو نقص أو تناقض، لذا فقد جاءت هذه الدراسة لمعالجة بين الإشكاليات القانونية آثارها التطبيق العملي لبعض القواعد القانونية، أو التي غفل النظام القانوني عن معالجتها، من خلال تحليل هذه القواعد وتأصيلها، والخروج بمعالجات قانونية لتلك الإشكاليات.
