إنّ الكرامة البشرية حقّ طبيعي لكل إنسان، فلا يجوز المساس بها تحت أي ظرف كان، وهذا يعني أنه، لا يجوز إخضاع أيّ إنسان سواء أكان موقوفاً على ذمّة التحقيق أو رهن المحاكمة أو مسجوناً للتعذيب أو العنف، لحمله على الإعتراف بجرم معيّن أو قضيّة ما.
ويُعتبر كل إعتراف انتُزع تحت الضغط أو الإكراه باطلاً قانوناً، فالهدف من عقوبة السجن هو تأديب وإصلاح السجناء وليس الإنتقام منهم.
لذلك، أقرّت المواثيق الدولية لحقوق الإنسان والإتفاقيّات والإعلانات الدولية المناهضة للتعذيب بمجموعة من الحقوق لكل إنسان، ومن بينها عدم جواز تعذيب أي إنسان مهما كانت ظروفه، وسواء أكان موقوفاً أو مسجوناً، ووضعت بعض الإتفاقيّات الدولية قواعد نموذجيّة لمعاملة السجناء لأجل حفظ كرامتهم، وكذلك، تضمّنت القوانين الجزائيّة بعض المواد التي تحفظ كرامة الموقوفين أو المسجونين.
وهذا الكتاب يتضمّن دراسة تحليليّة لحقوق السجناء والموقوفين على صعيد المواثيق أو الإتفاقيات والإعلانات الدولية والقوانين الجزائية، والقوانين المتعلّقة بتنظيم السجون وحماية الأحداث وتنفيذ العقوبات.
وبالإضافة إلى ذلك، تضمنت هذه الدراسة بعض الإقتراحات اللازمة لتخفيض نسبة الإكتظاظ في السجون.
