إنّ أحكام الإسلام، المتمثلة في شريعته السمحاء ، تكون على نحوين أو في إطارين: الأول: الإطار المغلق، ويحتوي على الأحكام الإلهية الشرعية ذات الطابع الثابت، وغير المتأثرة بعوامل الزمان والمكان، وهي أغلب العبادات وقسم المعاملات ذات الصبغة التأسيسية، وتتصف هذه الأحكام بالثبات والدوام والإستمرار، والإلزام في أغلبها.
الثاني: الإطار المفتوح، أو الحر، أو المتحرك، وهو عنوان هذا الكتاب، وقد عبّرنا عنه بــ (المساحة المفتوحة في التشريع الإسلامي)، ووظيفة هذه المساحة أو الهدف منها هو لتنعكس فيها تغيرات الحياة، وتبدل المواضيع، ومستجدات الزمان والمكان، فهي العنصر الحيوي في الشريعة الإسلامية، والمانح لها صفة العالمية والشمولية.
حدود المساحة المفتوحة هذه هو المباحات بالمعنى الأعم، أي ما يشمل المباح والمستحب والمكروه، دون الأحكام الإلزامية وجوباً أو تحريماً، وهي في الأحكام الحكومية التدبيرية لا ما كانت أحكاماً أولية إلهية، وعادة ما تكون في الأحكام الإمضائية لا في التأسيسية، وهي في ما لا نص فيه بخصوصه لا فيما ورد فيه النص، وهي أخيراً تشمل الموضوعات التي تتجدَّد وتتبدل في هيئتها وشكلها، أو في ماهيتها.
