تعاني صناعة الإنشاء في الوقت الراهن من لعنة قوى ثلاث، هي في جوهرها عبارة عن سوء تفاهمات؛ فزبائن الصناعة يسيؤون فهم قدرتها على تقديم منتجات خالية من المشاكل، ولا يتفهم المجتمع بأسره دور التأمين، كما أن الهيئات القانونية لا تتفهم الطبيعة الخاصة لعالم الإنشاء، وفي بيئة متزايدة الميل إلى التقاضي والمدفوعة بمصالح المستهلك والتي كانت في طور التكوين في الحقبتين الأخيرتين؛ فإن سوء التفاهمات الثلاثة تلك، تعمل على تقليص الموارد المهنية والتجارية والمادية المتاحة للمضي في عملية الإنشاء.
ويقدم هذا الكتاب مساهمة مهمة على سبيل تعميق فهمنا لطبيعة سوء التفاهمات المذكورة، وهكذا يتعين على أولئك الذين بيننا ممن هم مُولجون في صناعة الإنشاء أو ممن هم بين زبائنها، والذين ليسوا بمحامين ولا مهنيّي تأمين، أن يرحبوا بكتاب مرجعي في موضوع تأمين الإنشاء وضعه مهندس ممارس لا يعمل في ثلاثية الإنشاء بصفته مهندس تصميم إنشاءات من طراز رفيع فحسب، بل بصفته صاحب خبرة طويلة في عالم التأمين وفهم عميق له، أيضاً.
ما قام به الكاتب هو بيان مقدار إعتمادنا الكبير على دقة اللغة حينما يستدعى الخلاف حلاً قانونياً، وفي الوقت نفسه دلّل على أن اللغة تبرهن على عدم دقتها حينما توضع على المحك.
وهذا الوضع مسألة مألوفة في مجال عقود تنفيذ أعمال الإنشاء، ذلك المجال الذي تدهورت فيه العلاقة بين الأطراف من علاقة تسودها "الثقة بشكل أساسي"، إلى علاقة يسودها "روح التنازع" ونحن لم ندرك، إلى حدّ ما، أن المشاكل نفسها كانت بإنتظار عقود التأمين، وقد كان ظهور هذه المشاكل في السنتين الأخيرتين بمثابة صدمة لصناعة التأمين.
