تكمن أهمية موضوع توطين المعاهدات الدولية في القانون الوطني من خلال الآثار التي قد تنتج عن دمج المعاهدات الدولية في أحكام القانون الوطني، لذلك فإننا حاولنا في هذا الكتاب توضيح طبيعة العلاقة بين القانونين من خلال بيان مفهوم تدويل القواعد الوطنية، وكذلك كيفية توطين القواعد الدولية.
بيد أن هذه الأفكار تستوجب من الناحية العملية توافر بعض المبررات للقيام بإجراءات الدمج، فتوطين قاعدة دولية في قانون داخلي يستلزم إيجاد المسوغات القانونية لذلك، كما لا بد من تحديد الآليات القانونية التي يجري بها التوطين، إذ إن هذه الآليات قد تأتي من القانون الدولي بإعتباره مرسلاً للقاعدة الدولية، أم إن هذه الآليات قد تكون موجودة في القانون الوطني المستقبل للقاعدة الدولية؟...
ولا بد أيضاً من تحديد السلطات المختصّة بإستقبال المعاهدات وتوطينها، وبيان القيمة القانونية للمعاهدة الموطنة وتحديد آثار التوطين على الصعيد الوطني، وما يثيره من مشاكل نفاذ المعاهدة، وإلزام القاضي الوطني بها، ومشكلة الرقابة على نفاذها ودستوريتها، وكيفية تطبيق القاضي لهذه المعاهدة بتفسيرها وإثباتها.
