Fruit d'une analyse serrée des sentences arbitrales publiées - institutionnelles et ad hoc- l'étude de la résolution des contrats dans l'arbitrage commercial international met en lumière l'existence d'une véritable jurisprudence arbitrale. Elle montre également le rôle fondamental de l'arbitrage, juridiction de droit commun du monde des affaires, dans la structuration de la lex mercatoria et corrélativement dans la construction du droit du commerce international. En marge des particularités des droits nationaux, la jurisprudence arbitrale offre en effet un régime cohérent de la résolution du contrat. Il s'agit d'un ensemble de règles transnationales, créées ex nihilo par les arbitres ou, plus souvent, puisées dans les solutions du droit comparé - étatique et conventionnel - répondant le mieux aux spécificités des relations commerciales internationales. Ce régime repose sur deux mouvements apparemment contradictoires, conjuguant d'une part la limitation de la résolution en vue de la préservation de la sécurité juridique des transactions et, d'autre part, l'extension de la résolution pour la moralisation des relations contractuelles. La conciliation des impératifs de prévisibilité et de stabilité du lien contractuel avec ceux de la bonne foi et de la moralisation permet ainsi aux arbitres du commerce international de contribuer à l'instauration d'un environnement juridique efficace, propice au développement et à l'épanouissement des relations d'affaires.
