شَهِدَ العالم وخاصة في الربع الأخير من القرن العشرين وبدايات القرن الحالي تطورات هائلة في مجال إعداد وتعديل الدساتير الوطنية بما يتلاءم مع أسس النظام الديمقراطي ومتطلبات مستجدات القانون الدولي العام.
حيث سلك هذا المنهج الجديد - بعض البلدان الخارجة عن الإتحاد السوفيتي والعديد من الدول في أوروبا الشرقية، وآسيا، وأمريكا اللاتينية، وأفريقيا - في تبني دساتير جديدة بالأساليب الديمقراطية ومتضمنة لّلبنات الأساسية (المقومات الأساسية) للدستور الديمقراطي، بدءاً من التداول السلمي للسلطة ومبدأ الفصل بين السلطات، ومروراً بإقرار الحقوق والحريات العامة، والقضاء المستقل، والسيادة الشعبية، ومبدأ سمو القواعد الدستورية، ووصولاً بالمقومات الأخرى الثانوية المعززة للنظام الديمقراطي، كالحق في الوصول أو الحصول على المعلومات، والسيطرة المدنية على الأجهزة العسكرية، والأخذ بقواعد القانون الدولي والقضايا الدولية المستجدة.
وهذا ما دفع بالبعض إلى أن يطلق على هذا العصر تسمية عصر الدساتير أو ((عصر البناء الديمقراطي للدساتير))، فقرابة 60% من الدول الأعضاء في الأمم المتحدة قامت بإجراء تعديلات جوهرية في دساتيرها في العقد الممتد بين (1989 - 1999(، وإن 70% من النسبة المشار إليها من البلدان تبنت بصورة كلية دساتير جديدة.
ومن خلال بعث روح جديدة أصبحت هذه الدساتير تلعب دوراً أساسياً في عملية إستتباب السلم وإستقرار السياسة الوطنية والتطور والنمو الإقتصادي.
