إن الكلام عن الأنكحة الفاسدة يطول فهو ذو أطراف وأفرع وتفصيلات وتأتي الإطالة والتقصير بحسب الموضوع من حيث نوعه وأهميته، ومن حيث الاتفاق أو التباين في أقوال الفقهاء فيه، ولقد جئ بتمهيد مفصل على شاكلة باب من الأبواب لكي يلج منه القارئ في سهولة ويسر إلى صميم الموضوع المقصود، وهو تمهيد دقيق الصلة والارتباط بالموضوع نفسه فرأيت ألا مناص من بيانه كيلا يأتي الموضوع منقوصاً أو غير منسجم أبتر.
وقد تعرضت في هذه الرسالة لبيان المذاهب الفقهية الستة وهي: الأحناف، المالكية والشافعية والحنابلة والظاهرية والشيعة الإمامية، مع التركيز الواضح على المذاهب الأربعة الأولى المشهورة، أما المذهبان الآخران فقد تعرضت لذكرهما في ضوء ما تحصل لدينا من مصادر تشتمل على أقوال لهذين المذهبين.
وقد اعتمدت في ذلك كله على أمهات الكتب في مختلف المجالات، يضاف إلى ذلك ما استفدته من الكتب الحديثة التي كثيراً ما يستأنس بها الباحث عند الكتابة.
