إن محاكمات الحرب العالمية الثانية، لا سيما تلك التي جرت في نومبج وطوكيو السالف الإشارة إليهما. هو بداية الميلاد للقضاء الدولي الجنائي.
وإن كانت هاتين المحكمتين قد حدد اختصاصهما بخصوص جرائم محددة في زمن محدد- إلا أنه الحاجة مع التطور السريع المتلاحق للعلاقات الدولية كان وبالقطع في حاجة إلى محكمة ذات صبغة دولية تسعى إلى وضع حد للثقافة العالمية المتمثلة في الإفلات من العقوبة. ومن ثم فإن المحكمة الجنائية الدولية هي أول هيئة قضائية تحظى بولاية عالمية، وبزمن غير محدد. لمحاكمة مجرمي الحرب ومرتكب الفظائع بحق الإنسانية وجرائم إبادة الجنس البشري.
ونظرًا لما يحتله إنشاء المحكمة الجنائية الدولية من أهمية عالمية فلقد رأينا خوض تجربة الكتابة فيها رغم قلة المراجع بل وصعوبتها. ولكن بعون الله وبفضله وجدنا ما يمكن أن نقول عنه أنها شموع تضيء لنا الطريق للكتابة فيها.
