شهدت السنوات القليلة الماضية تطوراً كبيراً في المجتمع الدولي وفي العلاقات الدولية، ساهمت بصورة كبيرة في تطور قواعد ومبادئ القانون الدولي، ثم إنها أثرت كثيراً على المنظمات الدولية، ولم تكن الأمم المتحدة بمعزل عن هذه التطورات فقد ساهمت هذه التطورات في تطور وظائف الأمم المتحدة في العديد من المجالات كالتنمية وقضايا حقوق الإنسان والتدخل الإنساني والتدخل لإحلال الديمقراطية.
وفي مجال الديمقراطية ساعد التقارب بين القانون الدولي والقانون الداخلي على التداخل بين القانونين، مما جعل مسألة الديمقراطية تأخذ حيزاً ومجالاً في القانون الدولي، وأصبحت من القضايا التي تشغل الفقه الدولي والمنظمات الدولية التي بدأت تأخذ دوراً مهماً في عملية إرسالها، خصوصاً في ظل التطور الحاصل في العديد من المجالات كالتنمية والعولمة والمجتمع المدني وتغير طبيعة عمليات حفظ السلام، فضلاً عن التغير الكبير في طبيعة الصراعات المسلحة، فقد شهدت الفترة من أوائل التسعينيات تغيراً في هذه الصراعات إذ ظهرت صراعات مسلحة داخلية ناجمة عن الصراع على السلطة بين مختلف الفئات والعرقيات في الدول، مما دعا الأمم المتحدة إلى التدخل بصورة مباشرة في الشؤون الداخلية لهذه الدول وأصبح شكل النظام السياسي وخاصة الأخذ بالديمقراطية والإنتخابات والمحافظة على حقوق الإنسان وتعزيزها من المهام والوظائف الأساسية التي تضطلع بها المنظمة الدولية.
واستمر هذا التطور واستخدم أحياناً التدخل لإحلال الديمقراطية، في العديد من الدول مثل هاييتي وسيراليون، وقد أثارت هذه التدخلات خلافات فقهية وقانونية حول مدى مشروعية هكذا تدخل ومدى تطابقه مع مبادئ وقواعد القانون الدولي وتأثيره على هذه المبادئ والقواعد القانونية، ومدى نجاحه في الحفاظ على السلم والأمن الدوليين على صعيد المجتمع الدولي.
