لم يزل الفقه الإسلامي على اختلاف مذاهبه مقصدا للدرس الاستشراقي في العصر الحديث، حتى غدا هذا الدرس ملاذا لكثير من أولئك الذين ينشدون بحثا أكثر عمقا للمقولات الفقهية في السياسي والاجتماعي الذي أثمرها.
وتعد هذه الدراسة الصادرة ضمن سلسلة دراسات كامبردج في الحضارة الإسلامية، والتي تصدر في نسختها العربية عن مركز نماء – اول دراسة تعالج نشأة المذهب الفقهي الرسمي في حقبة ما بعد المغول، اذ يكتشف جاي بوراك الكيفية التي بلورت الاسرة العثمانية الحاكمة من خلالها فرعا خاصا داخل المذهب الحنفي بنية واختيارا.
ومن خلال النظر الى نشأة مفهوم المذهب الفقهي الرسمي، قصد الكتاب الى التشكيك في تلك السرديات الكبرى المتعلقة بتاريخ التشريع الإسلامي، والتي تجنح الى النظر الى القرن التاسع عشر الميلادي بوصفه عصر قطيعة كبرى. وقد برههن الكتاب عوضا عن تلك الرؤية، على ان بعض التطورات التي تفرض وقوعها في ابان القرن التاسع عشر، مثل تقنين الفقه الإسلامي، متجذرة في القرون السابقة. ولذلك فان الكتاب يقترح تحقيبا جديدا لتاريخ التشريع الإسلامي في الأراضي الإسلامية المشرقية.
