يقوم نظام السجل العيني من الناحية الفنية على إعداد سجل كبير لكل قسم مساحي مكون من عدة صحائف وتخصص صحيفة لكل وحدة عقارية. وتقيد في هذه الصحيفة كل المحررات التي يوجب القانون شهرها. وكلما توسع القانون في عدد المحررات الواجب شهرها كلما زادت أهمية السجل العيني ويزداد الدور القانوني للسجل العيني وتزداد حجية الصحيفة العقارية وما يثبت فيها من قيود، ويصبح السجل العيني هو الدليل الوحيد للحالة القانونية، فتترتب على ذلك حجية سلبية للسجل العيني وحجية إيجابية للسجل العيني. وسوف نعرض فيما بعد للمبادئ الأساسية التي يقوم عليها السجل العيني بما يسمح بقيام تلك الحجية، وسوف نعرض أيضًا للمقصود بتلك الحجية وما تنصرف إليه وشروط التمسك بها. ولو تركنا النظرة القانونية المجردة للسجل العيني فإن له فوائد اجتماعية واقتصادية.
وسوف نبدأ هذه الدراسة بفصل تمهيدي يتضمن مبحثين: المبحث الأول التعريف بالظاهر والمبحث الثاني التعريف بالسجل العيني ويلي ذلك تقسيم الدراسة إلى أربعة فصول: الفصل الأول يتناول إنشاء السجل العيني وأحكامه الرئيسية وعلاقة الظاهر بالسجل العيني، والفصل الثاني ويتناول حجية الظاهر الإيجابي من السجل العيني، والفصل الثالث ويتناول حجية الظاهر السلبي من السجل العيني، والفصل الرابع ويتناول حجية الظاهر خارج السجل العيني.
