إن ظهور أزمة مستعصية للإسكان، لأسباب اقتصادية واجتماعية ولعوامل متباينة أصبح تملك الشقق والطبقات ظاهرة اجتماعية وحلاً علمياً، وإن لم يكن مثالياً، لتلك الأزمة. بل أن تلك الصورة من صور الملكية أصبحت من أهم صور الملكية العقارية وأكثرها انتشارا في العصر الحاضر.
ويطرح هذا الوضع القانوني الجديد العديد من التساؤلات وتتولد عنه العديد من المشكلات القانونية، التي تعجز النصوص القانونية القائمة عن الإحاطة بها واستيعابها. وإزاء عدم كفاية التشريعات القائمة، فأنه ينبغي أن نتلمس الحلول في أحكام القضاء، فأنه وإن لم يكن مصدراً رسمياً من مصادر القانون في غالبية التشريعات العربية، إلا أنه مصدر غني وخصب من مصادر القاعدة القانونية.
ويهدف هذا البحث إلي دراسة النظام القانوني لملكية الشقق والطبقات في التشريعات العربية بوجه عام مع تركيز الدراسة علي استجلاء الوضع في الأنظمة السعودية والقانون المصري. ونظرا لتشابه التشريعات العربية فيما يتعلق بملكية الشقق والطبقات، فقد رأينا المقارنة بينها وبين التشريعات الفرنسية، الصادرة في هذا الشأن وذلك بالنظر إلي ما يوجد من تشابه في الأحكام والحلول.
وقد أبرزنا في البحث أحكام القضاء الفرنسي علي اختلاف درجاته، إذ أن التشابه في النصوص القانونية والمشكلات المثارة يؤدي إلي التشابه في الحلول التي يمكن أن نسترشد بها في هذا للمجال. وقد كان رائدا في هذه الدراسة هو البحث عن الحلول التي تثور في الواقع وابتعدنا بقدر الإمكان عن الجوانب النظرية التي لا تمثل أهمية أو انعكاساً لواقع علمي.
