إن السياسات الجنائية الحديثة تتجه نحو الحد من العقاب وبالفعل قام بعض الدول المتقدمة بتقنين نظام متكامل للعقوبات الإدارية التي توقعها الإدارة بما لها من سلطات قبل جمهور الأفراد خاصة فى ظل المتغيرات التي طرات على المجتمعات وتزايد حجم الجريمة، وقد تكون العقوبة الإدارية اشد وقعاً على المدان من العقوبة السالبة للحرية: كعقوبة سحب رخصة المركبة أول قفل المنشاة أو المصادرة وإلى غير ذلك من تلك العقوبات، ولذا فالاتجاه نحو إحلال العقوبات الإدارية محل الجنائية في بعض الحالات آخذ فى الإتساع وحتى فى البلاد التي لم تضع نظاماً متكاملاً لتلك العقوبات نجدها وقد ضمنت تشربعاتها المتفرقة العديد من تلك العقوبات مما يدل على أهميتها واثرها المثمر فى هذا الشأن.
