بتاريخ 8 / 7 / 2000 قضت المحكة الدستورية العليا بعدم دستورية تعيين رؤساء لجان الإقتراع من غير أعضاء الهيئات القضائية، وبتاريخ 12 / 7 / 2000 أصدرت الحكومة ونشرت القرار بقانون 167 لسنة 2000 بتعديلات تشريعية لمعالجة آثار ذلك الحكم العظيم، وبتاريخ 15 / 7 / 2000 نشرت صحيفة الوفد الوطنية نداءً بقلم رئيس تحريرها بعنوان (يا قضاة مصر.. قولوا لنا حتى تطمئن قلوبنا) تساءل فيه: اين نادي القضاة. وهل يحقق هذا التعديل توصيات مؤتمر العدالة الأول، وتوصيات ندوة نزاهة الإنتخابات اللذين عقدهما النادي في عامي 1986، 1990 والحك سالف الذكر؟ وإذ تلقى رئيس التحرير من كاتب هذه السطور جواباً شفوياً في اليوم ذاته. فقد بادر بنشره في اليوم التالي باعتباره مقالاً، وحرصاً على إستقرل القضاء. وسلامة تكوين السلطة التشريعية- فقد نشرت لي هذه الصحيفة الوطنية- عشرة مقالات تحليلية اسبوعية لقيت إحتفالاً كبيراً من السادة القراء، فبادرنا بتنقيحها تمهيداً لنشرها.. فكان هذا الكتاب.
