من وثائق محكمة القدس الشرعية نماذج من السجل (319) (1250-1251هـ/ 1834-1835م)
إن سجلات المحاكم الشرعية تحوي بين طياتها الكثير من المسائل الاجتماعية والاقتصادية والإدارية ، المتعلقة بالزواج والطلاق ، والبيع والشراء ، والوصية والإرث والمخلفات (المواريث) ، كما أنها ترصد لنا عمليات : البيع والشراء ، والإيجار والاستئجار ، والأراضي ، والخصومات ، والسرقات ، وغيرها من التفاصيل التي لا نجدها غالباً في المصادر التاريخية مطبوعةً كانت أو مخطوطة .
تعد المعلومات الواردة في سجلات المحاكم الشرعية موثوقةً ؛ كونها تخلو من الميول والاتجاهات ، إضافةً إلى أن من كتبها لم يقصد بها كتابة التاريخ ، وإنما قام بتسجيل الوضع القائم في تلك اللحظة.
ومما يزيد هذه السجلات مصداقيةً أنها تحمل اسم القاضي الشرعي وختمه ، واسم الكاتب ، وأسماء أطراف الدعوى ، والشهود .
اعتمد الباحثون في هذا الدراسة على سجل محكمة القدس الشرعية رقم 319 ، الذي يعود تاريخيه إلى الفترة (1250– 1251هـ / 1834– 1853م) ، والذي يحتوي على 192 صفحة ، بمقاس 70 X 30 سم .
تحتوي الصفحة الواحدة من هذا السجل على عدة حجج تتراوح ما بين ثلاث إلى ست حجج ، وقد تم اختيار سبعة عشر حجة شرعية من حجج هذا السجل .
