إن المحافظة على النفس البشرية المعصومة يعد أمراً ضرورياً من الكليات الأساسية الخمس التي رسختها الشريعة الإسلامية الغراء خاصة والشرائع كلها بصفة عامة إلا أن شريعتنا تميزت في وضعها للعلاج الذي يحفظ هذه النفس ويصونها عن كل اعتداء ظالم.
إن عقوبة القصاص وضعت للردع والزجر وليس للإنتقام كما يظن الظالمين والحاقدين على شرع الله وحدوده وأحكامه، فقد أحاطتها الشريعة الإسلامية بضوابط وشروط وقيود محددة سواء في جانب الإثبات أو الحكم أو التنفيذ.
ولقد بيّنت في هذه الدراسة معايير القصاص وميزت بينها وبين شروط القصاص، وما هو الأثر الذي ترتبه هذه المعايير على أحكام الدية، ملتزماً في ذلك ببيان آراء العلماء وأدلتهم مع التحليل والتدقيق والمقارنة بكل تجرد وإنصاف، مع بيان آراء فقهاء القانون وأحكام القضاء ما استطعت إلى ذلك سبيلاً.
