إنّ الصفة المميزة التي ينفرد بها الرهن الحيازي عن سائر الحقوق العينية التبعية، هي انتقال حيازة محل الحق العيني من يد الراهن (مديناً أو كفيلاً عينياً) إلى يد الدائن المرتهن (أو العدل) وهذا الانتقال هو الذي ينشئ حق الرهن الحيازي في أنظمة قانونية وضعية، مشايعة لجانب من مدارس (مذاهب) الفقه الإسلامي، أو يُلزم الراهن بتأمينه (نقل الحيازة إلى الدائن المرتهن أو العدل) باعتباره التزاماً على الراهن، كما ذهبت إلى ذلك أنظمة قانونية وضعية أخرى، مشايعة لجانب آخر من مدارس (مذاهب) الفقه الإسلامي. وإذا ما أصبحنا أمام رهن حيازي، بما يتطلبه ذلك من انتقال حيازة الرهن، فإن هذا الانتقال للحيازة تترتب عليه التزامات وحقوق في جانبي العقد (وعقد الرهن الحيازي عقد ملزم للجانبين Contrat synallagmatique).
وهذه الدراسة تعنى ببحث هذا الجانب البارز والمتميز الذي ينفرد به الرهن الحيازي، فهي تعرض لدور الحيازة في نشوء الرهن بين أطرافه، وفي نفاذه في مواجهة الغير ولماهية الالتزامات التي تثقل كاهل المتعاقدين، وللحقوق التي يتمتعان بها في ظل هذا العقد.
