طرحت الباحثة في هذا الرسالة الجادة، شكلاً ومضموناً، بين قائل بتحجيم دور القاضي وقاتل بالتوسع فيه، ولم يكن الأمر خفياً على المشرع المصري فنظم هذه المسألة على استيحاء، ووضع لها القواعد المنظمة لتدخل القاضي، فلا ينقلب مشرعاً لما هو غير موجود، ولا يكتفي بالنقد لما هو قائم، فحرص المشرع على أن يجعل القاضي "يكمل" العقد ومنحه دوراً إنشائياً، فينشئ القواعد ويضع الأحكام، مستهدياً في ذلك بمعايير عدة.
وكان مقصود المشرع من هذا كله هو حرمان القاضي من التعلل بقصور العقد عن تنظيم ما نشأ في ظله وترتب على وجوده، للتهرب من الفصل فيما يعرض عليه من أنزعه.
