أصبح التحكيم حاليًا من أهم الوسائل القانونية التي اتسع نطاقها حتى عم الاعتراف بها وتنظمها تشريعيًا معظم الدول رغم اختلاف أنظمتها القانونية وظروفها الاقتصادية، وذلك بهدف تحقيق العدالة السريعة بين المتنازعين خاصة في عقود التجارة الدولية.
ويؤكد ذلك الإقبال المتزايد بين المتعاملين سواء في مجال التجارة الداخلية أو الدولية في حسم خلافاتهم عن تعاملاتهم في هذا المجال عن طريق التحكيم.
ولقد اهتمت الدول الغربية والعربية على السواء بالتحكيم كوسيلة فعالة للفصل في منازعات التجارة الداخلية والدولية، فمنها من خصص له قوانين مستقلة مثل مصر التي أصدرت قانون التحكيم رقم 27 لسنة 1994، ومنها من خصص له بابًا مستقلًا في تشريعاتها المنظمة للتقاضي مثل قانون دولة الإمارات العربية المتحدة.
كما اهتمت الدول بالتصديق على الاتفاقيات الدولية في شأن التحكيم، ولعل أهمها اتفاقية نيويورك عام 1958 بشأن الاعتراف وتنفيذ أحكام التحكيم الأجنبية والتي انضمت إليها مصر بعد التصديق على أحكامها في 7 مارس 1959. ووضعت لجنة القانون التجاري الدولي بالأمم المتحدة قواعد خاصة بالتحكيم ونموذجًا لقانون للتحكيم عام 1985 "اليونسترال" يمكن للدول الاهتداء بأحكامه وقواعده عند إصدارها قوانين منظمة للتحكيم، والذي كان الأساس الذي استمد منه المشرع المصري أحكام قانون التحكيم رقم 27 لسنة 1994 بل والذي استمد منه المشرع في معظم الدول العربية والغربية.
