القانون الدولي الخاص فرع من فروع القانون يتميز بتشعبه وخصوصيته من حيث قواعده واتصاله بأكثر من فرع من فروع القانون الأخرى، وهو يختلف عن القانون المنظم للعلاقات الخاصة الداخلية كونه يقوم في منطلقة ومضمونه على مجتمع خاص ذو طابع دولي.
وهو يأتي لتحكيم العلاقات القائمة بين الأفراد من دول متعددة أو بينهم وبين دولة معينة، والأفراد من دولة واحدة على مادة أو واقعة خارج دولتهم، والقانون الدولي الخاص يقوم على مبدأ مسلم به ويرجع إلى القرن الثالث عشر وهو القبول بتطبيق القانون الأجنبي ما أدى إلى تبلور علم جديد هو (تنازع القوانين) والذي يشكل موضوع الرئيسي. والتنازع كظاهرة وجد قديماً مع اتصال الشعوب وارتباط أفرادها بعلاقات تقتضيها الطبيعة الإنسانية وحاجتها للتعامل والالتقاء. كما أن النظرية العامة لتنازع القوانين التي يقرها الفقه ويعتمدها التشريع والقضاء المعاصرين وليدة محطات أنضجتها ومراحل ومسار تطوري ساهم في بلورتها.
يقع الكتاب في مقدمة وقسمين المقدمة وضعت للتعريف بالقانون الدولي الخاص. والقسم الأول يبحث في منهجيته حل النزاعات الخاصة الدولية عبر تقنية تنازع القوانين، بينما يبحث القسم الثاني في تطور طرق حل النزاعات الخاصة الدولية، الحد من تنازع القوانين.
