من خلال رصد الاستمرار في تفتيت الملكية الزراعية دون معالجة جدية للأجزاء المفتته، أصبح من المؤكد أن الخطورة في ذلك تنبئ عن واقع أليم حتى لو تصورناه بعد عدة عقود، وأن ما نتج عن التفتيت المشار إليه هي المسوغات القانونية والإقتصادية والإجتماعية والبيئية لاختياري هذا الموضوع.
ويشمل البحث التفتيت القانوني للأرض الزراعية أساسياً للأطروحة مع عدم إغفال التفتيت الواقعي. أما المناهج التي اعتمدت عليها لإنجاز الأطروحة فهي: المنهج التحليلي للقوانين التي عالجت التفتيت وما نتج منها من آثار إيجابية وسلبية، المنهج المقارن من خلال مقارنة آثار التشريعات التي عالجت التفتيت بمثيلاتها من القوانين المقارنة وقد اعتمدت في ذلك على التشريع الفرنسي واللبناني والليبي والمغربي والمصري.
لذلك اقتضت الضرورة المنهجية أن يكون تبويب الأطروحة بالشكل الآتي: الفصل الأول تطور أحكام الأراضي الزراعية خصوصيتها في العراق، الفصل الثاني تفتيت ملكية الأراضي الزراعية، الفصل الثالث معالجة الملكية الزراعية المفتتة في القانون المقارن، الفصل الرابع التنظيم المقترح للحد من تفتيت الملكية الزراعية.
