على الرغم من أن التقنين المدنى الجديد قد نظم الملكية الشائعة تنظيما مفصلاً، إلا أن الشيوع لا زال مصدر متاعب، فكثيراً ما يختلف الشركاء فى الشيوع، والقسمة قد تكون اتفاقية وقد تكون قضائية، وتكون القسمة اتفاقية إذا حقق جميع الشركاء على إجرائها بالتراضى، فإن لم يتيسر الاتفاق فتكون القسمة عن طريق الالتجاء إلى القضاء، وهذه هى القسمة القضائية. وتتخذ القسمة القضائية صورة دعوى، تنعت بدعوى القسمة. وفيما يلى تعرض لثلاث ملاحظات يتعين على الأحكام الصادر فى هذه الدعوى مراعاتها:
الملاحظة الأولى تتعلق بجزاء عدم اختصام جميع الشركاء فى الدعوى "المادة 836/ 1 مدنى". والملاحظة الثانية تتعلق بشروط تطبيق المادة 841 مدنى. أما الملاحظة الثالثة فأنها تتعلق بمصروفات الدعوى، وهى مسائل لاحظنا تضارب الأحكام بشأنها.
