التعارض الظاهرى بين الأخبار -أو اختلافها- يسعى المجتهد إلى دفعه عن طريق الجمع أو النسخ أو الترجيح، على خلاف بين العلماء فى الأولى بالتقديم من هذه المسالك، ويعتبر هذا النوع من التعارض من أهم أسباب إختلاف الأئمة الفقهاء.
وللأئمة السابقين عناية كبرى بجمع الأحاديث المختلفة ظاهرا، ثم النظر فيها، وبيان ما ينتج عن نظرهم ذاك: فألف الإمام الشافعى رحمه الله كتاب اختلاف الحديث.
ونظرا لأهمية هذا الموضوع؛ ففيه ذود عن السنة النبوية، وإثبات لعلو قدر الفقهاء، وما أوتوا من فهم دقيق ونظر حكيم -أحببت أن أضرب بسهم فى هذا المجال العظيم، وأن أكون ممن لهم شرف الدفاع عن هذا المعين، وذلك الصرح الشامخ على قدر ما أتيح لى من إمكانيات، فبذلت جهدى للوقوف على الأخبار المتعارضة فى الفقه الإسلامى، وبيان موقف الأئمة نحوها، مقدما من الآراء ما هو أولى بالتقديم، طبقا لما قدمت به من دراسة أصولية تتضمن ما قرره الأصوليون فى دفع التعارض، وتتناول المرجحات التى على أساسها يتم تقديم أحد الخبرين المتعارضين على الآخر، متتبعا فى ذلك الواقعى منها، ممثلا له، ومتجنبا ما هو افتراضى ونظرى لا غير؛ إذ الأول أولى بالاهتمام والبحث.
ويتكون البحث من بابين رئيسين:
الباب الأول: تعارض الأخبار وما يتعلق به
والباب الثانى: فى موقف العلماء من الأخبار المتعارضة فى الفقه الإسلامى.
