في ظل الإهتمام المتزايد بالجريمة والمتهم عد ضحايا الجريمة طرفاً سلبياً في الجريمة، ولم يحظ هؤلاء بأية عناية تُذكر، وعملت أغلب التشريعات الجنائية إلى التضييق من حق ضحايا الجريمة، والتقليل من شأنهم ووضعت أمامهم العراقيل عند لجوئهم إلى القضاء، ولم يكن لهذا الأمر المعكوس والغريب الإستمرار ، إذ أن المنطق والعدالة يقتضيان بأن يكون ضحية الجريمة جديراً بالرعاية والعناية مثل المتهم تماماً، إن لم يكن أجدر منه فالضحية لا يعد طرفاً سلبياً في الجريمة، بل إنه طرف إيجابي فيها، فمن خلال الدعوى الجزائية يمكن للضحية الذي مست الجريمة حقوقه أو اعتدي عليها أن يطلب إعادة الحق إلى نصابه، وملاحقة المتهم المعتدي وإنزال العقاب به، ولا بد من إيضاح حقوق ضحايا الجريمة وتقديم السبل المختلفة التي تساهم في تقديم العون والمساعدة إليهم، ويعد هذا البحث مبادرة عملية نحو تحقيق حماية اكثر وأشمل لضحايا الجريمة للقضاء على المشاكل والمآسي الإجتماعية التي لا حصر لها التي تلحق الضحايا بسبب الجريمة.
