لما كانت الخبرة من الموضوعات التي لم تستقر قواعدها التشريعية بعد وبصفة خاصة في التشريعات المقارنة، لذلك رأينا أن تشمل دراستنا بعض القواعد الواردة في التشريعات القديمة للمفاضلة بينها وبين ما استحدثه المشرع في الموضوع، بالإضافة لدراسة بعض أحكام الموضوع في كل من دولتي الامارات والكويت والنظام المعمول به في كل منها، خاصة ما استحدثه المشرع الكويتي في موضوع الخبرة من أحكام وذلك للمقارنة بالقواعد المختلفة التي تحكم نظام الخبراء مع التنويه على أنه في حالة ذكر لفظ المشرع أو الفقه أو القضاء فقط فيكون المقصود بذلك النظام المصري، وقد رأينا معالجة هذا الموضوعفي إطار خطة تتضمن مقدمة عامة- على نحو ما سبق- ثم فصل تمهيدي- ثم قسمين موزعين على أربع أبواب وخاتمة. نعالج في القسم الأول دور الخبرة في فحص الدلة باستخدام الوسائل العلمية الحديثة، وذلك في بابين:ـ الباب الأول الطبيعة القانونية للخبرة الجنائية في ثلاثة فصول، الخبرة من الناحية الإجرائية (الفصل الأول) أهمية الخبرة بالنسبة للقضاء (الفصل الثاني) النظم المختلفة في الخبرة الجنائية (الفصل الثالث)، ونعالج في الباب الثاني استعانة الخبراء بالوسائل العلمية الحديثة في الدعوى الجنائية:ـ نتناول في الفصل الأول موضوع الخبرة الجنائية ونتناول في الثاني استعانة الخبراء بوسائل الاستعراف في الاثبات الجنائي ونتناول في الفصل الثالث دور الخبرة الفنية في بحث الوسائل العلمية التي تستخدم خفية وفي الفصل الرابع الحالات التي لا يجوز فيها الاستعانة بأهل الخبرة ونعالج في القسم الثاني تقدير حجية تقارير الخبراء في الإثبات أمام القضاء الجنائي وذلك في بابين.
