لقد تطورت الظاهرة الإجرامية فى الآونة الأخيرة تطورا مذهلا سواء فى أشخاص مرتكبيها وهو مايطلق عليهم ذو الياقات البيضاء, أو فى أسلوب ارتكابها والذى يتمثل فى استخدام أخر ما توصل إليه العلم وتطويعه فى خدمة الجريمة.
فقد أصبح النظام المعلوماتى فى نهاية القرن الماضى من لوازم الحياة الضرورية والمتطورة على المستوى العام أو الخاص. ولا يخفى أن كل تطور تقنى تكون له انعكاساته على المستوى القانونى بصفة عامة وفى إطار القانون الجنائى بصفة خاصة, فكل المخترعات الحديثة تثير بعض المصالح والحقوق التى تحتاج إلى الحماية الجنائية لها سواء فى إطار النصوص التقليدية أو بإستحداث النصوص الملائمة لطبيعتها والدور الذى تؤديه فى مختلف مجالات النشاط حيث تؤثر فى الإنسان كيانا ونشاطا.
كما أن البحث فى المواجهة القانونية للأنظمة المعلوماتية مسألة تتسم بالدقة وتكتنفها صعوبات كثيرة ولعل من أهم هذه الصعوبات هى معرفة الجوانب الفنية لتلك الأنظمة إذ أنه من الصعب على رجل القانون أن يبحث فى الجوانب القانونية دون الإلمام بالجوانب الفنية للموضوع محل البحث, فلا يكفى أن يكون الباحث متخصصا فى القانون بل يجب أن يكون خبيرا فى الجوانب الفنية للأنظمة المعلوماتية, لأنه يهدف ببحثه إيجاد الحلول للمشاكل القانونية التى تثيرها هذه الأنظمة.
ولعل ذلك هو السبب الذى دفعنى إلى البحث فى هذه الدراسة التى تؤكد على أهمية إيجاد الحلول القانونية لتحقيق هذا التوازن بين مصلحة المجتمع فى الإستفادة من المستحدثات العلمية وحماية المصالح والحقوق التى تولدت عنها.
وقد كان تعلقى بالقانون الجنائى هو الدافع الأكبر لأن أبحث فى النظام القانونى المطبق فى مصر وبعض الدول العربية والأجنبية بالنسبة لما يرتكب من جرائم باستخدام هذه التقنية الخطيرة التى بالرغم مما لها من فائدة كبيرة للمجتمع إلا إنها جلبت إليه أنماطا جديدة من الإجرام الذى يتزايد يوما بعد يوم.
