نتناول فى هذا الكتاب الثمرة الكبرى من الزواج, والفرع الأوفر فى الأسرة, وهم الأولاد, فلا يمكن لمن يبحث فى فقه الأسرة أن يمر بالأولاد دون أن يبحث فى أحكامهم, وما راعاه الشرع من المقاصد نحوهم. ذلك أن الشرع الحكيم أعطى الأولاد أهمية كبرى, بإعتبارهم من المستضعفين الذين يحتاجون إلى من يتولاهم ويكلفهم ويحفظ حقوقهم.
وقد رأينا أن حقوق الطفولة بحسب ما تدل عليه النصوص, ترجع إلى الحقوق التالية:
الحقوق للنفسية: ونريد بها مراعاة الجوانب النفسية للطفل, حتى يشب شخصاً سوياً خالياً من العقد التى قد تؤثر فى توجهات حياته, وأدائه لوظيفته.
الحقوق الصحية: ونريد بها الحقوق التى تضمن سلامة الأولاد الجسدية, بدءاً من حقهم فى الحياة, وإنتهاء بحفظهم من العلل, وحقهم فى كل ما تحتاجه سلامة جسدهم من نفقات.
حقهم فى التربية السليمة: وفق الأساليب الصحية التى لا تؤثر فى شخصيتهم نفسياً من جهة, كما أنها تؤدى دورها فى تحقيق الأبعاد التى تتكون منها الشخصية السوية.
حقهم فى التربية على ما تستلزمه الشخصية السوية من أبعاد: وهو من أهم الحقوق.
حقوق القاصرين من الأولاد: ونريد بهم من ليس لهم أسرة كاملة, سواء فقد الأب والم جميعاً من غير أن يعرف أحد منهما, وهم اللقطاء, أو بفقد أحدهما, وهم اليتامى, أو بإنفصال الأبوين, وهم أولاد المطلقات.
وسنتحدث فى هذا الكتاب بحسب ما نتصوره من المعنى الشامل للفقه, لا المعنى المحدود الذى إشتهرت به كتب المتأخرين, والتى لم تتحدث من هذه الجوانب إلا على النزر اليسير.
ولذلك ستكون أكثر مراجعنا فى هذا الكتاب زيادة على كتب الفقه: القرأن الكريم الذى هو الأصل, وتفاسيره, والسنة المطهرة, وشروحها.
