أطروحتنا الموسومة بـ: (عقود التنقيب عن النفط وإنتاجه- دراسة قانونية تحليلية مقارنة) تدور في النفط وقضاياه، وفي تطورات استثماره من خلال الأنماط المختلفة للعقود الخاصة به، تنقيبًا وإنتاجًا وعمليات أخرى، ويواجه الجدل العراقي حول التغييرات البنيوية التي حدثت للعراق بعد 9 نيسان 2003م بالنسبة لصلاحيات الحكومة الاتحادية وحكومات الأقاليم في إدارة النفط والغاز والخطة الاستراتيجية بشأنها بسبب تحول النظام العراقي من نظام مركزي شديد التركيز إلى نظام اتحادي فدرالي لا يجعل النفط من الصلاحيات الحصرية للحكومة الاتحادية.
وتهدف دراسة موضوع عقود التنقيب عن النفط وإنتاجه إلى توضيح وبيان ما يلي: من هو صاحب ملكية الثروة النفطية في الدساتير والتشريعات المنظمة للثروة النفطية في الدول المنتجة للنفط؟ وكذلك بيان موقف الشريعة الإسلامية حول ملكية المعادن ومن ضمنها الثروة النفطية، وكذلك بيان مدى صلاحيات الأقاليم أو الولايات المكونة للدولة الفيدرالية في التصرف بالثروة النفطية من خلال عرض تحليلي لموقف دساتير الدول الاتحادية مع التركيز على صلاحية إقليم كوردستان العراق في التصرف بالثروة النفطية الكامنة في أراضي الإقليم وبيان مدى إمكانية هذه الأقاليم في التعاقد مع الشركات الأجنبية لغرض التنقيب عن النفط وإنتاجه. مبدأ السيادة الدائمة على الثروات الطبيعية من خلال عرض تأريخي لهذا المبدأ في أروقة منظمة الأمم المتحدة وبيان أهم القرارات الصادرة.
ومن أجل عرض ما ما يتعلق بعقود التنقيب عن النفط وإنتاجه بحيث يستجيب للمشكلات التي عرضناها إجمالًا في هذه المقدمة نقسم البحث على ثلاثة فصول كالآتي: الفصل الأول: النظام القانوني لملكية الثروة النفطية والسيادة الدائمة عليها، الفصل الثاني: أنماط عقود التنقيب عن النفط وإنتاجه والطبيعة القانونية لها، الفصل الثالث: آثار عقود التنقيب عن النفط وإنتاجه (حقوق والتزامات الشركات الأجنبية والدولة المضيفة)، ثم نختم الدراسة هذه بإثبات ما توصلنا إليه من نتائج وما نقترحه من توصيات.
