في قراءته للواقع النفطي في العراق يقدم الدكتور صباح عبد الكاظم شبيب الساعدي مقاربة (قانونية - اقتصادية) لعقد التطوير والإنتاج النفطي في بلاده، وذلك من خلال بيان تطوره التاريخي، وطريقة إبرامه، وحقوق والتزامات طرفيه، وطبيعته القانونية، وتسوية منازعاته.
وفي هذا الإطار يكشف المؤلف عن أبعاد أخرى في حقل الاستثمار النفطي في العراق يرى فيها: "أن عقد التطوير والإنتاج النفطي هو عقد اقتسام إنتاج، تكون شركة النفط الأجنبية فيه بمركز المقاول الذي يحصل على حصة من النفط الخام مقابل ما يقوم به من أعمال. وهذا النوع من العقود لم يستخدمه العراق سابقاً، فقد كان يستثمر نفطه استثماراً مباشراً من خلال المؤسسات أو الشركات المختصة، بعد قرارات التأميم الخالدة التي أنهت كل أشكال الامتيازات النفطية. ونتيجة للحصار الاقتصادي الجائر وحاجة العراق إلى رأس المال والإمكانيات الفنية الأجنبية اتجه إلى إبرام هكذا عقود مع شركات تنتمي إلى دول صديقة لها مواقف إيجابية في الظرف الراهن..."، من هنا يحث المؤلف إلى ضرورة تشريع قانون نفط عراقي، ينظم كل ما يتعلق بالصناعة النفطية ومن ذلك شكل هذه العقود وطريقة إبرامها والجهة الحكومية المخولة بالتوقيع عليها، أي استحداث شركة استثمارات نفطية تكون مهمتها التعاقد مع شركات النفط الأجنبية لتطوير الحقول النفطية وتكون في الوقت نفسه هي الشريك الوطني في هذه العقود (...) وأخيراً قد يكون نافعاً من وجهة نظر المؤلف تأسيس مركز متخصص يسمى "مركز البحوث النفطية" يختص بدراسة الصناعة النفطية من الجوانب التاريخية والسياسية والاقتصادية والقانونية، أسوة بما هي عليه الحال في وجود "مركز البحث والتطوير النفطي" الذي يختص بدراسة الجوانب العلمية لهذه الصناعة...
