رغم إتجاه الحكومة المصرية إلى توطيد علاقاتها السياسية والإقتصادية بالنظام الأمريكي، وتأثر كثير من النظم الإقتصادية والسياسية المصرية بالنظم المعمول بها في أمريكا رغم التفاوت بينهما في التقدم الحضاري إلا أن النظام القضائي المصري لم يتأثر البتة بالنظام القضائي الأمريكي، ولم يقتبس منه شيئاً أساسياً إلا الأخذ بأحد الأمور الفرعية التي لا تمس جوهر النظام القضائي ذاته.
نظراً لأن هذا المؤلف مقدم لأبناء العربية، ولم يسبقه من كتب فيه كان من الطبيعي أن يبدأ هذا البحث بمقدمة نيبن بها عناصر البحث بوضوح، بحيث لن يكون ما بداخله سوى تفصيل لما ورد في مقدمته، وذلك عن طريق بيان أنواع المحاكم المدنية الأمريكية، سواء أكانت محاكم ولايات أم محاكم فيدرالية وسواء أكانت محاكم أول درجة أو محاكم إستئناف مع لمحة تاريخية عن كل نوع، ثم عرضنا للإجراءات المتبعة أمام هذه المحاكم خلال نظر الدعوى والفصل فيها، وفي خلال العرض نحاول أن نربط بين ما يتم في إنجلترا وأمريكا بإعتبار أن أمريكا قد نقلت نظمها عن إنجلترا.
وفي نهاية البحث عرضنا لقضاة المحاكم الأمريكية من حيث بيان كيفية تعيينهم وتقاعدهم، ولأن هذا البحث يتطلب كل جزء فيه مجلدات كان من الطبيعي أن نقتصر على المعالم البارزة لكل نظام دون خوض في التفاصيل، وقد قسمنا هذا البحث إلى ثلاثة أنواع هي أنواع المحاكم المدنية الأمريكية، إجراءات نظر الدعوى في المحاكم الأمريكية، وأخيراً قضاة المحاكم الأمريكية تعينهم وإنتهاء خدمتهم.
