إن أهمية الإعلام السابق علي التعاقد لا تخفي عن أذهان أولي الألباب، نظراً للدور الكبير الذي يلعبه في تنوير العاقد وتبصيره بكل ما يتصل بالعقد المزمع إبرامه من معلومات جوهرية تؤثر في تكوين رأيه بشأن العقد، خاصة بعد أن أصبح للتطور الصناعي والتقدم التكنولوجي، دخل كبير في تزايد الحاجة إلي الإعلام قبل التعاقد كالتزام قانوني يقع علي عاتق أحد الراغبين في التعاقد أو كليهما للتبصير بالأمور الجوهرية في العقد، لاسيما وقد امتلأت الأسواق بالعديد من السلع والمنتجات الفنية المعقدة، والتي يصعب- إن لم يستحل- علي غير المتخصص فيها والخبير بدقائقها العلم بها بالقدر الذي يعينه علي تكوين رضائه بها رضاء حراً ومستنيراً، الأمر الذي يستوجب ضرورة الاعتراف بالإعلام قبل التعاقد كالتزام قانوني يلقي علي عاتق أحد طرفي العقد المزمع إبرامه لتنوير إرادة العاقد الآخر، متي توافرت شروط وجود هذا الالتزام علي عاتقه وبذلك يمكن تلافي وقوع إرادة العاقد في أحد عيوب التراضي (كالغلط أو التدليس) الأمر الذي يساعد علي استقرار العقود بعد إنشائها.
