الإلتزام بالتسامح يقتضي ان يمتنع الدائن عن تحميل المدين فوق طاقته، بان يبذل الدائن قصارى جهده لعدم تحميل المدين فوق طاقته. ويهمنا في هذا المقام دراسة التزام الدائن بالتسامح إزاء المدين المتعثر في التنفيذ لالتزاماته على أكمل وجه بفرض حد أدنى من التضامن بين أطراف العقد. ويثور الحديث عن الالتزام بالتسامح بمناسبة الدفع بعدم التنفيذ وكذلك بمناسبة الفسخ، وهنا تظهر أهمية الكلام عن الالتزام بالتسامح حيث أنه لا يوجد نص في التقنين المدني الفرنسي، بعكس القانون المصري، يحدد آلية الدفع بعدم التنفيذ يمكن الاستناد إليه، ولذلك لم يكن هناك مناص من ضرورة البحث عن أسانيد لهذا الدفع في قبيل ذلك الأمانة العقدية والتسامح وغيرها وهذا ما تلجأ إليه بعض القوانين الحديثة.
