بالرجوع إلى نصوص قانون الإجراءات الجزائية الاتحادي نجد انها أخذت بنظريتي البطلان القانوني والبطلان الذاتي حيث نصت المادة 221 على أنه "يكون الاجراء باطلاً إذا نص القانون صراحة على بطلانه أو إذا شابه عيب لم تتحقق بسببه الغاية من الاجراء"، ومن أحوال البطلان القانوني التي وردت بالقانون عدم مراعاة أحكام القانون المتعلقة بتشكيل المحكمة أو بولايتها للحكم في الدعوى أو باختصاصها من حيث نوع الجريمة المعروضة. وسوف نتناول ما ورد بالقانون بشيئ من التفصيل على النحو التالي: أولا: أنواع البطلان،ثانيا: أثر البطلان، ثالثا: تجديد الاجراء الباطل، رابعا: تحقق الغاية من الاجراء، خامسا: تصحيح الخطأ المادي.
وقد أخذ المشرع في دولة الامارات العربية المتحدة بالنظام المختلط للاجراءات الجنائية، وتمر الدعوى الجنائية في ظل هذا النظام بمراحل التحري والتحقيق الابتدائي والمحاكمة.
