L’autonomie de la volonté dans les contrats internationaux est un des thèmes les plus stratégiques du droit international privé, suscitant des débats passionnés depuis plus d’un siècle et demi déjà, ses partisans insistant sur ses avantages pour le commerce international et ses détracteurs avertissan contre ses dangers multiples. Parmi ceux-là, le contrat sans loi occupe une place prvilégiée, notamment chez Henri Batiffol, qui le dénonçai passionnément, sans relâche.
A l’heure où l’autonomie de la volonté s’est imposée d’une manière flagrante, quasiment dans le monde entier, y compris dans les textes internationaux majeurs relatifs au droit international privé des contrats, comme le Règlement Rome I de 2008 notamment, cet ouvrage approfondit l’étude de sa relation avec le contrat sans loi, pour mieux rejeter ce danger et toutes les dynamiques plus ou moins similaires, favorisant, directement ou indirectement, une exacerbation de l’autonomie de la volonté dans le droit international privé de contrats (choix uniquement motive par la permissivité de la loi choisie, manipulations nomrmatives encore plus audacieuses, comme le dépeçage de validation ou le gel volontaire de la loi choisie…), au service d’un libéralsime contractuel quasi-absolu, sans pour autant rejeter le role traditionnel de la faculté de choix dans ce domaine, indéniablement utile et légitime, dans les contrats internationaux.
Ainsi, la seule voie légitime est la “moyenne”, conciliant toujours, autant que possible, les besoins de prévisibilité des solutions et de justice des parties avec le intérêts légitimes fondamentaux des Etats et les besoins de la société internationale.
Justement, cet ouvrage étudie aussi les nombreux garde-fous, classiques ou modernes, comme l’application des lois de police étrangères, susceptibles de contribuer au raffermissement de l’autorité de la loi dans le commerce international. Il offer ainsi une nouvelle réflexion approfondie sur l’autonomie de la volonté dans les contrats intenrationaux est ses limites, destinée au large public des jurists (praticiens et étudiants), autant qu’aux specialists du domaine.
