آثرت تناول هذا الموضوع الهام، حيث أن الماضي القريب والبعيد كان ينظر إلى نظام الحماية الدبلوماسية كنظام بغيض يكون أداة تستخدمه الدول الاستعمارية للتدخل في الشئون الداخلية للدول، بل وقد تتذرع بهضم حقوق رعاياها بدون مسوغ من أجل احتلال غيرها من الدول والسيطرة عليها, ولذلك اختلفت الدول الضعيفة والصغيرة ما يسمى بشرط كالفو لإجبار الفرد على التنازل عن الحماية الدبلوماسية لدولته لهضم حقوقه بالرغم من أنه يشكل دعامة من دعائم اقتصادها القومي ولكن تفعل ذلك لخوفهم من تدخل الدول الأخرى في شئونها الداخلية والهيمنة عليها واستعمارها, ولكن سيترتب على المطالبة بإلغاء الحماية الدبلوماسية وتنازل الأفراد عنها, افتقاد هؤلاء الأفراد والمشروعات الخاصة لضمانة هامة يلوذوا إليها عندما يمس الضرر حقوقهم ومصالحهم.
ولذلك نبدأ هذا البحث بفصل تمهيدي يبين تعريف الحماية الدبلوماسية وأساسها القانوني وتقييمها, ثم نتناول في الباب الأول الإتجاه السائد في الفقه والذي يصف الطبيعة القانونية للحماية الدبلوماسية التي تمارسها الدولة, ثم يجيء الباب الثاني- بيت القصيد- والذي نحاول فيه إثبات نظرية الحماية الدبلوماسية الواجبة والتي بدأ جانب من فقهاء القانون الدولي يميلون إلى الأخذ بها بعد أن بدأت دفة القانون الدولي تهتم بالفرد وتعلي شأن حقوق الإنسان, وسنناقش في هذا الباب مدى مشروعية تنازل الدولة عن إجراء الحماية الدبلوماسية والمبررات التي تسوقها في تبرير هذا التنازل حيث تدعى بفكرة الصالح العام, أو إنها تتصرف في حق خالص لها, أو أن عملها عمل من أعمال السيادة وهذا ما سوف نناقشه.
