ويأتي في مقدمة المسائل التي كانت في الماضي من أمهات المسائل التي تدخل في نطاق الاختصاص الداخلي للدول والتي تم تدويلها مسائلة احترام حقوق الانسان باعتبار ذلك من المكاسب الرئيسية التي حصل عليها عصر التنظيم الدولي لصالح بني الانسان.
وبموجب ذلك لم يعد من حق الدول رفض التدخل في شئونها الداخلية بمدعاة أن مسائل حقوق الانسان على أراضيها تدخل في صميم اختصاصها الداخلي وذلك لأنها غدت من المسائل الدولية التي ينشغل بها المجتمع الدولي، وتلك هي المسألة الأولى التي نناقشها في الباب الأول بعد أن نستعرض فيه مجالات أو دعائم الاختصاص الداخلي والذي يشمل الاختصاص الإقليمي المنفرد على كل ما يوجد على إقليمها كما يشمل اختصاصها المرفقي والذي ينصرف الى سلطة الدولة المنفردة في إدارة مرافقها واستغلال مواردها.
وقد بدأت الدول الكبرى تسئ استغلالها ةتفسر حقوق الانسان بالطريقة التي تروق لها مستغلة الطابع النسبي الذي تتصف به حقوق الانسان، بل وحاولت دس بعض الحقوق الى مسائل حقوق الانسان أو تفسيرها بطريقة تخدم أهدافها الاستعمارية، وصل الأمر الى حد إتهام الشريعة الاسلامية بإنتهاك حقوق الانسان فكان لزاماً علينا أن نحاول إثبات براءة الشريعة الاسلامية من هذا الاتهام. ولذلك سنعرض في الباب الثاني مفهوم حقوق الانسان في الموائيق والاتفاقيات الدولية حتى التي صدر منها في عقدنا الحالي ومفهومها في الشريعة الاسلامية بصورة مقارنة.
ثم نعرض في الباب الثالث للضمانات القانونية التي حاول رجال القانون بها سواء على الصعي الوطني أو الدولي إرسائها من اجل كفالة الاحترام لهذه الحقوق وذلك بجعلها حقوق دستورية بالنص عليها في صلب الدستور ذاته فتحظى بإحترامه وتستلهم ذات قوته أو بدمج حقوق الانسان في قوانينها الوطنية.
ثم اخيراً نتناول في الباب الرابع متى يكون التدخل مشروعاً من أجل كفالة هذه الحقوق حتى ولو بالتدخل في شئون الدول، وما شروط هذا التدخل المشروع وما هي ضوابطه، ومن هي الجهة المنوطة بهذا التدخل وما هي سلطاتها وما هي حدود هذا التدخل، وسنبين أن تلك الظوابط تشكل الخيط الرفيع الذي يفصل بين التدخل المشروع والمباح في شئون الدول وبين التدخل غير المشروع.
