يهتم قانون العقوبات بمعالجة كل الأوامر والنواهي الأساسية التي يلزم مراعاتها لحسن الحياة الاجتماعية. ولهذا يثير قانون العقوبات اهتمام المواطنين كافة، فيعملون على الإلمام بأفكاره ومعانيه، فيتميز بذلك عن قوانين أخرى مثل القانون التجاري والقانون البحري وغيرهما من القوانين.
ويتمثل قانون العقوبات في مجموعة القواعد القانونية التي تحدد الجرائم، وتبين الأشخاص الذين يمكن مساءلتهم عنها، وتحدد العقوبات التي يجوز تطبيقها، وقد يشترك قانون العقوبات مع غيره من القوانين في مواجهة السلوك غير الاجتماعي، ولكن يتميز هذا القانون عنها بأنه لا يتدخل إلا حماية للمصلحة العامة أو ضمانا للحقوق والحريات بالقدر الضروري لهذه الحماية وبالتناسب مع الضرر أو الخطر الذي يهددها, وعلة ذلك أن للتحريم والعقاب تأثيرا مباشر في المساس بالحفوف والحريات مما لا يجوز معه استخدامها إلا إذا اقتضت الضرورة ذلك، وكان العقاب متناسبا مع الهدف من التجريم، وفي الأقسام الأربعة لهذا الكتاب نتناول مصادر قانون العقوبات ونطاق تطبيقه، التجريم والإباحة، التكوين القانوني للجريمة وأخيراً المسئولية الجنائية، وذلك بعد باب تمهيدي يوضح ويبين فكرة قانون العقوبات بوجه عام.
