Cet ouvrage, qui réunit des études de droit intercommunautaire et de droit international privé, se propose de décrire les problèmes posés par le pluralisme des statuts personnels dans les sociétés multicommunautaires.
Ces problèmes sont particulièrement sensibles dans les États du Proche-Orient, notamment au Liban où les structures politiques sont fondées sur la représentation des diverses communautés, toujours attachées à leurs coutumes et traditions. Le statut personnel demeure le domaine où les particularismes des communautés s’expriment avec le plus d’intensité et où leur harmonisation est recherchée et imparfaitement réalisée.
La coexistence de statuts multiples sur un même territoire provoque en effet des conflits de lois et de juridictions dont les solutions, si elles s’enracinent dans l’histoire et la configuration des États, manifestent aussi des orientations puisées dans le droit moderne.
L’examen de ces conflits conduit naturellement à leur rapprochement des conflits de systèmes juridiques qui surgissent dans les relations internationales. Ce rapprochement permet d’observer à côté de ressemblances frappantes des originalités propres. Il revêt un intérêt accru dans les États multicommunautaires du fait que le pluralisme des status personnels qui y est établi rejaillit nécessairement sur les techniques et solutions du droit international privé dont on doit constater, dans ces États, l’infléchissement et l’adaptation.
Les études que cet ouvrage réunit s’adressent ainsi non seulement aux juristes du Proche-Orient, mais aussi aux comparatistes et aux internationalistes de droit privé qui pourront y trouver un terrain spécifique de documentation et de réflexion.
