Book Description
Le droit est défini, par son objet, c’est l’ensemble de règles de conduite que la société impose à ses membres, au besoin par la contrainte et s’appelle "droit objectif".
De même les droits sont aussi defines par leur sujet, ce sont les prerogatives ou les pouvoirs reconnus à une personne sur une chose (droit de propriété) ou à l’égard d’une autre personne (droit de Créancier) et s’appellent "droit subjectifs".
Le seul rapport entre les deux droits est que le droit objectif a pour objet de réglementer, préciser, garantir et protèger des droits subjectifs.
La différence entre les deux sens est telle qu’ils sont exprimés en arabe par deux mots différents. Le droit objectif correspond à "Kanoun" tandisque les droits subjectifs sont dits "Houkouks", la différence est done plus nette en arabe.
L’ouvrage expose les notions fondamentales du droit (règle de droit, construction du droit, sources du droit, personalité juridique, droits patrimoniaux et extra-patrimoniaux, litiges entra les personnes et preuve des droits). Il a vocation principalement pédagogique, produit de l’expérience de plusieurs années d’enseignement, il propose l’accès à cette matière don’t l’approche doit permettre aux étudiants, à la fois, de mieux saisir l’importance sociale du droit et d’en acquérir les clés essentielles, quelque soit leur orientation future.
Il s’adresse avant tout aux étudiants qui découvert la matière, mais aussi aux praticiens soucieux d’élargir leurs connaissances, il est une iniation au langage technique du droit.
