تقتصر هذه الدراسة على البحث في التحول إلى القطاع الخاص بمفهومه (الضيق) الذي يتناول أساليب تحويل المشروعات العامة إلى القطاع الخاص، دون أن نبحث في الأساليب الأخرى التي تدعم أو تعزز دور القطاع الخاص في ممارسة النشاط الإقتصادي التي تدخل ضمن المفهوم الواسع للتحول إلى القطاع الخاص والذي تتبناه الدراسات الإقتصادية الحديثة.
واعتمد الكاتب في هذا البحث على المنهج المقارن وذلك بالمقارنة بين التشريع العراقي من جهة والتشريع الفرنسي والمغربي والمصري من جهةٍ أخرى، غير أن هذه المقارنة لم تكن مكتملة في جميع جوانب البحث، وذلك لأنّ كلاّ من المشرع الفرنسي والمغربي قد أصدر تشريعاً خاصاً بعملية التحول إلى القطاع الخاص، في حين أجاز كل من المشرع العراقي والمصري هذه العملية دون أن يخضعها لتشريع واحدٍ مستقل.
