لأن القانون الإداري غير مُقنن - هذا التوصيف مُسلم به لدى كل فقهاء هذا القانون - فذلك يعني أن المُشرِّع قلّما يتصدى لتفاصيل ذاك القانون، بل غالباً ما يضع القواعد التي يستنبطها القضاة الإداريون من خلال قراراتهم، التي تفصل في القضايا المطروحة أمامهم، ولذا يحفل هذا القانون، لا بل تتزاحم فيه الإجتهادات التي تؤسس لمبادئ جديدة تواكب سُنّة التطور وكل ما يطرأ من مستجدات في العلاقة البينية بين الإدارة والمواطن.
لذلك يبقى قدر القضاء الإداري، أن يكون خط الدفاع الأول عن حقوق المواطن وحرياته، رافضاً أي تطاول من الإدارة على المواطن، لذلك وعلى حد قول أحد فقهاء هذا القانون - تولى رئاسة مجلس الشورى في لبنان [الرئيس يوسف سعد الله الخوري] - الذي رأى: "أن من يواكب ويعيش هذا القانون القضائي الرائع، لا يستطيع أن يبقى مكتوف اليدين، صامتاً، أصم، بل عليه أن يتسلح بما يدفعه إلى الإنعتاق من القيود، وإلى الحديث بصوت عالٍ، أينما كان لنقل الحقيقة عارية كما هي، فيتحول من رجل قانون عادي، إلى رسول يزرع الطمأنينة بإستنباطه الحلول العادلة، التي من مقتضاها أن يقال للحق أنت حق، وللباطل، أنت باطل".
