إن تولي المرأة العربية الولاية العامة (الرئاسة، الوزارة، القضاء، الإفتاء، عضوية البرلمان) من الأمور المهمة والمختلّف حولها، وهذه الدراسة تحاول إعادة النظر في دور المرأة العربية في المجتمع في ظل تحوّلات السياسية العالمية والإجتماعية، التي أفردت نماذج عديدة لنساء كثيرات نجحن في رئاسة الدولة ورئاسة الحكومة وغير ذلك من الولايات العامة.
ومن الطبيعي أن تهتم الدول بأمر الولاية؛ لأن صلاحها منعقد بصلاح الوالي، وإسناد الولايات العامة إلى المرأة يحتاج إلى وقفات مع نصوص الكتاب والسنّة وأحكام الفقه، مقارنة بالقوانين المعمول بها في الدول العربية.
وهذه الدراسة تمعن النظر في تولي المرأة الولاية العامة من خلال دراسة تحليلية، مقارنة بين الآراء الفقهية والقوانين العربية على إختلافها، خاصة بعد أن كثر الحديث في هذا الموضوع؛ فقد كان أكثر المتكلمين فيه بين مبالغ في التقنين يريد سدَّ جميع أبواب المشاركة العامة أمام المرأة العربية، وبين مبالغ في فتح هذا الباب على مصراعيه دون مراعاة ثوابت الإسلام وثقافة المجتمعات العربية.
كما تكشف الدراسة ما لحق ببعض القوانين العربية من تطوير تجاه تمكين المرأة من الولاية العامة، وتُظهر العوامل التي تساعد على زيادة مشاركتها في السياسة، والمعوقات التي تمنعها من ذلك.
