لقد أريد من دراسة قواعد الإكتتاب وضوابطه في الشركة المساهمة في القانونين اللبناني والعراقي، إجراء مراجعة تفصيلية للأحكام التي تحكم عمل القائمين على إجراءات الإكتتاب في هذه الشركة، مقارنة ببعض نصوص القانون المصري إجراء مراجعة تفصيلية للأحكام التي تحكم عمل القائمين على إجراءات الإكتتاب في هذه الشركة.
وقد أظهرت هذه الدراسة التقارب بين القانونين العراقي واللبناني في تنظيم الكثير من القواعد والضوابط المتعلقة بالإكتتاب في الشركة المساهمة، وسكوتهما في المقابل، في مواضع معينة عن تنظيم بعض الأحكام التي قررتها القوانين المقارنة، مع الإقرار بوجود إختلافات معينة بين القانونين في تنظيم بعض الأعمال المتعلقة بالدراسة المذكورة.
